These Terms of Service ("Terms") govern your use of the services provided by Kingdom Code LLC ("Kingdom Code," "we," "us"). By purchasing or using our services, you agree to these Terms.
1. Services
Kingdom Code provides recurring website services — design, build, hosting, and maintenance offered as monthly subscription plans — and custom software development through our Enterprise Division. The specific features included depend on the plan or written proposal you select.
2. Fees and recurring billing
Subscription plans include a one-time setup fee and a recurring monthly fee at the prices listed on our Pricing page or in your proposal. By starting a subscription, you authorize us to charge the recurring fee to your payment method each billing period until you cancel.
Custom development is quoted separately and billed as set out in the applicable proposal or statement of work.
3. Payment processing
Payments are processed by Stripe, Inc. We do not store your full card details. Your use of payment features is also subject to Stripe's terms and privacy policy.
4. Refunds and cancellation
Refunds are governed by our Refund & Dispute Policy, and subscription cancellations by our Cancellation Policy. Both are incorporated into these Terms by reference.
5. Your responsibilities
You agree to provide accurate account information and to supply the content and materials we need to deliver your service in a timely manner. You confirm that any content you provide — text, images, logos, and other materials — does not infringe the rights of others, and you grant us the license needed to use it to deliver your service.
6. Intellectual property
You retain ownership of the content and materials you provide to us. Kingdom Code retains ownership of its underlying tools, templates, and code unless a separate written agreement transfers specific deliverables to you. While your subscription is active, we grant you a license to use the website we host and maintain for you.
7. Disclaimers
Our services are provided "as is" and "as available." We work to keep your website online and functioning but do not warrant uninterrupted or error-free service. We are not responsible for outages caused by third-party providers, including hosting, scheduling, payment, or email services.
8. Limitation of liability
To the maximum extent permitted by law, Kingdom Code's total liability arising out of or relating to the services is limited to the amount you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the date below. Your continued use of our services after a change takes effect constitutes acceptance of the updated Terms.
